TERMS OF SERVICE and AUP
1. This agreement contains the terms and conditions that apply to your purchase of products and services ("Products") from myhost123.com (“Company”). Please read these terms and conditions of sale carefully. They contain very important information about your rights and obligations, as well as limitations and exclusions that may apply to you (“User”).
2. By accessing, browsing and/or otherwise using this web site ("Site"), you acknowledge that you have read, understood and agreed to be bound by these terms and conditions. If you do not agree to all of these terms and conditions, you may not access, browse and/or use this Site.
 
USER RIGHTS
3. Once payment is received, User has the right of use of related products in a normal, continuous and stable manner.
4. Once payment is received, User has the right to freely dispose of related products.
5. Once payment is received, Company guarantees related products are consistent with product description and technical parameters User viewed on the Site.
 
USER OBLIGATIONS
6. In the use of Products, User acknowledges that User has read, understood and agreed to comply with all applicable laws and regulations in United States of America.
 
PROHIBITED USES
7. Following uses of Products are prohibited:
7.1. Pornography;
7.2. Phishing site;
7.3. Spamming;
7.4. Spreading virus and/or trojan horse;
7.5. Distributed denial of service attacks;
7.6. Hacking;
7.7. Open proxies or Internet Relay Chat (“IRC”);
7.8. Copyright infringement activities including but not limited to selling counterfeit products and pirated goods;
7.9. Any activities violate User’s local laws and regulations.
 
LENGTH OF SERVICE
8. The length of service starts from the moment when Company receives User’s payment and ends at the moment when User’s service is cancelled either by User’s request or Company’s action per terms and conditions in this agreement.
 
RENEWALS
9. Company will send the new bill to User 10 days before the payment due date. If User doesn’t pay the bill by 12 o’clock at night (User local time) on the due date, Company reserves the right to stop User’s VPS without notice.
10. If User doesn’t pay the bill after 24 hours after the due date (User local time) or after initial order submission, Company has the right to permanently delete User’s VPS without notice.
 
REFUND POLICY
11. Company has no refund policy. Please consider carefully before the purchase.
 
WARRANTY DISCLAIMER
12. Company assumes no responsibility what so ever for causes of loss or damage to User’s VPS and data on the VPS when following situations occurred:
12.1. Arrears (intentionally or unintentionally);
12.2. Misuses performed by User;
12.3. User activities in violation of the sixth and seventh provisions;
12.4. War, armed conflicts, strikes, riots, insurrections and other major non-normal social events;
12.5. Earthquakes, tsunamis, typhoons, floods, locusts, storms, hail, dust storms, volcanic eruptions, landslides, avalanches, landslides and other natural disasters.
13. Company has the right to perform following actions without notice when User’s VPS consumes abnormal bandwidth:
13.1. Clear router for 24 hours;
13.2. Stop VPS;
13.3. Delete VPS.
 
BREACH OF CONTRACT
14. Company will delete all User’s data and will not provide any data backup or monetary compensation if User violates the sixth and seventh provisions.
 
DATA BACKUP
15. Company has no obligation to provide data backup service.
 
PAYMENT
16. To prevent fraudulent transactions, Company only accepts payments from secure payment methods, including but not limited to verified Paypal and Alipay accounts. If User violates this term, Company will cancel User’s order immediately and provide the refund to the User. Company reserves the rights to deduct the transaction fee from the refund amount.
 
REVISIONS TO THIS AGREEMENT
17. Company may revise this Agreement at any time without notice by updating this posting. By using this Site you agree to be bound by any such revisions and should therefore periodically visit this Site and page to determine the then current terms and conditions of use to which you are bound.
